OVERVIEW

These Terms of Service (“Terms”) govern your access to and use of the website www. sinowisechina .com (the “Site”) and all services, programs, bookings, and educational travel activities provided by Sinowise Discovery (“we,” “us,” “our”). By using the Site, registering for programs, or making a payment, you (“you,” “user,” “parent,” “guardian”) agree to be bound by these Terms.

1. Eligibility & Parental Responsibility

You must be at least 18 years old to use this Site and register participants.

A parent or legal guardian must register all participants under 18, and that parent or legal guardian accepts full responsibility for the participant’s compliance with these Terms, program rules, safety instructions, and conduct during the program.

2. Program & Service Description

We provide educational travel, study tours, workshops, cultural exchange, and related logistics services including accommodation, transportation, meals, and educational activities. Program details, dates, fees, and inclusions are set forth in the program description, confirmation, and itinerary provided at booking.

3. Booking, Payment & Cancellation

  • Full payment or required deposit is due at booking.
  • Cancellations must be submitted in writing. Fees apply based on timing and actual incurred costs.
  • We reserve the right to cancel programs due to insufficient enrollment, force majeure, or safety concerns; we will refund all payments received minus non-recoverable costs.
  • No refunds for missed days, early departure, dismissal for misconduct, or failure to complete required documentation.

4. Participant Conduct & Discipline

Participants must follow all instructions from staff, respect others, maintain safety, and refrain from disruptive, illegal, or harmful behavior.
 
We may remove any participant from a program at our sole discretion for safety or rule violations. No refund will be provided, and parents/guardians are responsible for all related costs (transportation, accommodation, etc.).

5. Health, Safety & Insurance

You warrant that participants are physically and mentally able to participate. You must disclose all medical conditions, allergies, and special needs prior to departure.
 
We are not a medical provider. Emergency assistance is provided but not guaranteed.
 
We strongly recommend that you obtain comprehensive travel, medical, and accident insurance. We are not liable for losses not covered by our insurance or caused by your failure to obtain coverage.

6. Changes to Programs & Itineraries

We reserve the right to modify or adjust itineraries, transportation, accommodation, or activities when necessary due to safety, weather, transport delays, government orders, or force majeure. We will make reasonable efforts to maintain program quality. Such changes do not constitute a breach of these Terms.

7. Personal Information & Privacy

Your use of personal information is governed by our Privacy Policy. By using the Site, you consent to the collection, use, storage, and disclosure of personal data as set forth in the Privacy Policy for program operation, communication, and compliance purposes.

8. Prohibited Uses

You may not use the Site or services for unlawful, infringing, harmful, or abusive purposes; transmit malicious code; scrape data; or violate third-party rights.

9. Disclaimer of Warranties

Services are provided “as is” and “as available.” We do not warrant uninterrupted or error‑free service. All implied warranties are disclaimed to the fullest extent permitted by law.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Sinowise Discovery shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits, lost data, or personal injury, arising from your use of services or participation in programs, except in cases of our willful misconduct or gross negligence.

11. Indemnification

You agree to indemnify, defend, and hold harmless Sinowise Discovery from all claims, damages, losses, and expenses (including legal fees) arising from your breach of these Terms, participant misconduct, or your negligence.

12. Governing Law & Dispute Resolution

The laws of the People’s Republic of China govern these Terms.

The parties shall first resolve any dispute through good‑faith negotiation. If unresolved, we may elect to submit the dispute to arbitration in Shanghai, China in English, or to the competent courts in Shanghai.

13. General Provisions

We may update these Terms at any time. Continued use after posting constitutes acceptance.

If any provision is held invalid or unenforceable, the remaining provisions remain in full force.

These Terms constitute the entire agreement between you and Sinowise Discovery.
